Who Qualifies for Chapter 7? The Means Test

What Exemptions Protect Your Home and Car?

Exemptions are what you get to keep. Some states force you to use state exemptions; others (including NJ and FL) let you choose state or federal. The 2025–2028 federal exemptions (§522(d)):

  • Homestead: $31,575 of home equity (per filer; spouses can double).
  • Motor vehicle: $5,025.
  • Wildcard: $1,675 plus up to $15,800 of unused homestead (max $17,475) — usable on anything.
