Do You Need an SR-22 in New Jersey or New York in 2026? What They File Instead
Short answer. New Jersey and New York do not use the SR-22. Neither the MVC nor the DMV asks an insurer to file that certificate, so nothing is ever filed to these two states and no filing fee for them exists. A policy written in Brooklyn or Edison can still carry a filing into another state, when the carrier is admitted there, and that fee is real. Each state replaced it: New Jersey bills a surcharge of $1,000 a year for three years after a first or second DWI plus a $100 restoration fee, and New York makes your insurer file coverage electronically and charges $8 to $12 for every lapsed day. The form becomes your problem only when another state holds your record. Informational, not legal advice.
Do New Jersey and New York require an SR-22 in 2026?
No. Read the official restoration paths and the form never appears. The MVC page on suspensions and restorations lists four steps: satisfy the reason, serve the period, pay the $100 fee, send proof the fines were paid. An insurance document is asked for in one narrow case, an uninsured motorist suspension, and it is a copy of your New Jersey insurance card or declarations page. Not a certificate.
New York removes the driver from the loop. Under the DMV rules on auto liability insurance, your company must notify DMV electronically every time coverage begins, ends or resumes, and the page is blunt: your insurance ID card alone does not prove coverage. Out-of-state insurance is not accepted for a New York registered vehicle.
What does New Jersey charge instead of an SR-22?
Money, billed yearly by the New Jersey Surcharge Violation System. The MVC surcharge page publishes the schedule, and each assessment repeats for three years.
| Trigger | Per year | Three-year total |
|---|---|---|
| Six points within three years | $150 plus $25 per extra point | repeats while points stand |
| First or second DWI | $1,000 | $3,000 |
| Third DWI within three years | $1,500 | $4,500 |
| Refusing the breath test | $1,000 | $3,000 |
| Operating an uninsured vehicle | $250 | $750 |
| Driving on a suspended licence | $250 | $750 |
Two details matter if you move between states. Under N.J.S.A. 17:29A-35 a New Jersey licence holder convicted of a similar DWI elsewhere is surcharged here, and a driver licensed elsewhere convicted in New Jersey is surcharged too. To drive again with a balance open you pay at least 5 percent of it plus the $100 fee, in two separate payments. There is no work-only hardship licence.
What does New York file instead of an SR-22?
Coverage, continuously, priced by the day when it gaps. The floor is $25,000 per person and $50,000 per accident for injury, $50,000 and $100,000 for death, $10,000 property damage, per the DMV page on insurance requirements.
| New York event | What it costs |
|---|---|
| Lapse, days 1 to 30 | $8 per day |
| Lapse, days 31 to 60 | $10 per day |
| Lapse, days 61 to 90 | $12 per day |
| Lapse over 90 days | No penalty option, plates go in |
| Registration suspended over 90 days | Licence suspended, $50 termination fee |
| Crash while uninsured | Revocation at least a year, $750 penalty |
| Court fine for driving uninsured | Up to $1,500 |
The penalty option also disappears if you used it within the previous 36 months. New York does have SR forms, which is where confusion starts: the SR-60 exists, but it is a Supporting Affirmation a crash victim files against a motorist with an unsatisfied judgment over $1,000. It is not proof of your insurance.
How much does SR-22 filing typically cost with a New York City car insurance policy?
Nothing when the filing would go to New York, because New York accepts none. An agency quoting a Brooklyn or Queens SR-22 is selling a filing for a different state, and that filing is legitimate: the limit is whether the carrier is admitted in the state holding the suspension, not the address on the policy. Progressive states it can file an SR-22 anywhere in the United States and folds the fee into the cost of each policy term; the figure it prints, roughly $25, it attributes to U.S. News rather than to its own book, and it repeats the same $25 on its non-owner page. Allstate describes the same mechanics: the insurer files the certificate electronically with the state and charges a one-time filing fee where the form is used. Those are insurer fees, not premium. The purely local numbers are the daily civil penalty and the $750 that ends a revocation. If this is your first car in the country, our page on buying one without a credit history covers the insurance step that comes attached.
Which states actually use the SR-22, and for how long?
| State | Certificate | How long |
|---|---|---|
| Texas | SR-22, minimums 30/60/25 | Two years from the conviction that requires it, or from the date a crash judgment was rendered, $100 reinstatement |
| Illinois | SR-22 | Three years, $70 fee, or $70,000 with the Treasurer |
| Florida | SR-22, plus FR-44 after a DUI | FR-44 at 100/300/50 for three years |
| Virginia | SR-22, plus FR-44 after a DUI | FR-44 doubles the 50/100/25 floor in Va. Code 46.2-472 |
| Ohio | SR-22 or bond | One year for a first non-compliance or a 12-point suspension dated on or after April 9, 2025; three years if it was added earlier, and five for a repeat non-compliance added earlier |
| South Carolina | SR-22 | Three years, $100 reinstatement |
| Missouri | SR-22 | Two years from the start of the suspension or revocation in most cases, $20 reinstatement fee |
| AZ, CA, GA, IN, OR, TN, WA | SR-22 or state equivalent | Tied to the suspension or revocation |
| NJ, NY, PA | None | Surcharges, electronic filing, plate surrender |
| NC, MN, MI | Own forms: DL-123, PS35016, FR certificate | Case by case |
Two rows deserve a second read. Ohio shortened the certificate to one year, and the cut is broader than most summaries admit: the BMV page on insurance suspensions puts a first non-compliance offense added on or after April 9, 2025 at one year, against three years for one added before that date, and the 12-point suspension page applies the same one year to suspensions starting after that date. A second or later non-compliance offense inside five years, added before April 9, 2025, still carries five years. A judgment suspension under ORC 4509.37 carries its own certificate on its own terms, and a security suspension after an uninsured crash with more than $400 in property damage runs up to two years on top. And Michigan will not take the application from you: the insurer's home office files the certificate with the Secretary of State.
Another state wants an SR-22 and I live in Brooklyn or Edison. Where do I get it?
Here is where the money is lost. The hold sits on the record of the state that suspended you, and your home state cannot lift it.
- Oregon offers no exit: its DMV states you must file there even living out of state, from an insurer doing business in Oregon, and another state may refuse to licence you meanwhile.
- Tennessee keeps the requirement on its reinstatement record until the Department of Safety clears it; check the e-services reinstatement page before assuming a move ended it.
- Illinois lets an out-of-state resident ask the Secretary of State to waive the SR-22 with the Out of State Affidavit Financial Responsibility Insurance Waiver, form DSD FR 9; the $70 reinstatement fee stays.
- Virginia lets a nonresident send a letter on the insurer's letterhead with the doubled FR-44 amounts.
- Texas requires the filing even from a driver who owns no vehicle, which is what a non-owner policy is for.
None of this needs a local policy. It needs a carrier admitted where the file sits, a separate purchase that stacks awkwardly onto a family auto package.
What does a lapse actually add up to in New York?
The daily rate is quoted everywhere; the arithmetic almost never is, and it is the arithmetic that decides whether you pay or surrender the plates. The DMV works the numbers itself on the auto liability insurance page, in two worked examples.
| Length of the lapse | Civil penalty, calculated in bands | The alternative |
|---|---|---|
| 25 days | $200, that is $8 per day for 25 days | Surrender the plates and serve a 25 day registration suspension |
| 90 days | $900: $240 for days 1 to 30, plus $300 for days 31 to 60, plus $360 for days 61 to 90 | Surrender the plates and serve a 90 day suspension |
| Over 90 days | No penalty option at all | Plates go in, and the registration suspension lasts as many days as the vehicle was uncovered |
| Suspension running past 90 days | The licence is suspended too, and reinstatement costs $50 | For a suspension effective before July 6, 2009 the termination fee is $25 |
Two rules sit around this table and both are easy to trip over. The penalty option is also unavailable if you used it for a registration suspension within the previous 36 months, which turns a second lapse into a plate surrender however short it was. And the suspension is measured by days without coverage and without the plates having been turned in, which is why the DMV keeps repeating one line: no insurance, no plates. Motorcycles are the single exception, their plates need not be surrendered when coverage lapses, though riding uninsured stays illegal.
Five beliefs that turn a small problem into a suspended licence
| What drivers believe | What the agency says | Source |
|---|---|---|
| "I will move out of New Jersey and the surcharge dies with the licence" | You remain responsible for surcharges even after moving out of state and surrendering the New Jersey licence, and an unpaid balance becomes a Certificate of Debt in Superior Court with wage garnishment behind it | MVC surcharge page |
| "A defensive driving course will wipe the surcharge" | Neither the three-point safe driving credit nor the two-point defensive driving reduction lowers the surchargeable point total | MVC surcharge page |
| "The surcharge clock starts on the ticket date" | It starts on the posting date, when the conviction reaches your driver record, not the day of the ticket or the day the court processed it | MVC surcharge page |
| "My agent will file my coverage with the New York DMV" | Only the insurance company can file electronically. An agent or broker cannot, and paper proof or an email is not acceptable | DMV auto liability insurance page |
| "When the term is up the SR-22 falls off by itself" | The policy does not remove it automatically; you have to ask the insurer, and if the policy lapses while the filing stands the insurer notifies the DMV and the licence is suspended | Progressive SR-22 page |
There is a sixth belief with a purely financial ending. If a judgment is filed for unpaid New Jersey surcharges, the state may apply the Set Off of Individual Liability programme and redirect money it owes you: a New Jersey income tax refund, a property tax rebate, lottery winnings, certain unclaimed property. Nothing about that requires you to be driving at the time. Balances and payment plans run through the New Jersey Surcharge Violation System on (844) 424-6829, not through the MVC, and surcharge payments sent to the MVC are returned.
Two typical scenarios
Typical scenario one. Ilnur registers a car at his sister's address in Brighton Beach 11235 and buys an online SR-22 package for a suspension he picked up in Texas. The hold does not move: Texas DPS wants an SR-22 and $100 on its own record, and a New York policy cannot produce one. He pays twice and drives suspended for four months.
Typical scenario two. Klavdiya keeps a New Jersey licence and an apartment in Edison 08817 while wintering in Sunny Isles 33160. A Florida DUI plea puts her on FR-44 limits of $100,000, $300,000 and $50,000 for three years under Fla. Stat. 324.023, with a $350,000 certificate of deposit the only alternative and a reinstatement fee up to $500. New Jersey then adds $1,000 a year for three years. Two states, one conviction.
What to ask before paying for SR-22 insurance here
- Which state holds the suspension, and what is the order date?
- Is the carrier admitted there? A filing from a company that does not write in that state is worthless.
- Owner or operator form? A driver with no vehicle needs the non-owner version.
- Who pays the filing fee, once or every term, and what ends the obligation?
What a filing looks like when we place one is set out on our SR-22 page, and a request goes through the quote form. If your driving history starts abroad the order of operations differs: see SR-22 with a Russian licence, exchanging a Russian licence in 2026, and the step by step SR-22 after DUI guide. If the car came from abroad, start with registering an imported car; if you are pricing a policy from scratch, see what sets the price in Central New Jersey.

Frequently Asked Questions
Does New Jersey require an SR-22?+
No. The MVC restoration path is a $100 fee plus any surcharge balance. An insurance card is requested only for an uninsured motorist suspension.
Does New York require an SR-22?+
No. Your insurer must file coverage electronically with DMV instead, and the DMV states that your insurance ID card alone does not prove coverage.
How much does an SR-22 filing cost with a New York City policy?+
Nothing if the filing would go to New York, which accepts none. A policy written here can still carry a filing to another state: Progressive puts that fee near $25 per term.
What does New Jersey charge after a DWI instead of an SR-22?+
A surcharge of $1,000 a year for three years on a first or second DWI, $1,500 a year on a third within three years, plus a $100 restoration fee.
What does a lapse in coverage cost in New York?+
$8 per day for days 1 to 30, $10 for days 31 to 60, $12 for days 61 to 90. Over 90 days the civil penalty option is gone and plates must be surrendered.
I got a DUI in Florida but live in New Jersey. What now?+
Florida requires FR-44 limits of 100/300/50 for three years under Fla. Stat. 324.023, and New Jersey adds its own surcharge under N.J.S.A. 17:29A-35.
Can a New Jersey or New York insurer file an SR-22 for another state?+
Only a carrier admitted in the state holding the suspension can file there. Oregon, for example, requires a filing from an insurer doing business in Oregon.
How long does an SR-22 last?+
Three years in Illinois and South Carolina, two in Texas and most Missouri cases, one in Ohio for a first non-compliance or 12-point suspension from April 9, 2025; older Ohio records run three years.
