How to Receive a Russian Pension While Living in the USA (and What the WEP Repeal Changed)
Two moments send people to this page. The first is the month a Social Security claim is filed and the interviewer asks whether you receive "any pension from work not covered by Social Security." The second is the month the payment from the Social Fund of Russia (SFR, the former Pension Fund) does not show up anywhere you can reach it. As of August 2026 both answers have changed: the Windfall Elimination Provision is repealed, and on the Russian side two separate rules now block money from leaving Russia, one dating from 2015 and one adopted in January 2026. These are two different systems, and confusing them is what costs money. Below is what each does now, with the exact rule, form and address behind every statement.

Does a Russian Pension Reduce Your Social Security? WEP and GPO After the Fairness Act
For decades a foreign pension triggered the Windfall Elimination Provision, because the work behind it was not covered by US Social Security. That rule is dead. The SSA page Pensions and work abroad won't reduce benefits, last updated 8 January 2026, states it in one sentence: "For benefits payable for January 2024 and later, WEP and GPO no longer apply."
The law and who it covered
The Social Security Fairness Act was signed into law on 5 January 2025. SSA describes the affected population as over 2.8 million people receiving a pension from work not covered by Social Security, and names three groups explicitly, the third of which is "people whose work had been covered by a foreign social security system." A pension from SFR is exactly that. December 2023 was the last month WEP and GPO applied.
If your check was already being cut
SSA began adjusting payments on 25 February 2025 and paid arrears back to January 2024. By 7 July 2025 SSA had issued over 3.1 million payments totaling $17 billion under the Act. People already on the rolls filed nothing; SSA asked only that the address and direct deposit details on file be correct.
If you never applied because of WEP or GPO
This is the expensive case. The Act did not touch the rules on retroactive applications: for retirement and survivor claims, retroactivity is generally limited to six months before the month you file. Every month you wait is a month you cannot recover. Widows and widowers whose benefit was zeroed out by the Government Pension Offset are in the same position: the offset ended for benefits payable January 2024 and later, but somebody has to file.
Does Russian Work History Give You Social Security Credits?
No, and this is the most common misunderstanding. Eligibility runs on credits: you need 40 credits for retirement benefits, and in 2026 one credit costs $1,890 in covered earnings, with $7,560 buying the maximum four for the year.
Why Russian stazh cannot fill the gap
Credits from another country count only under a totalization agreement. SSA's list of agreements contains 30 countries, from Italy in 1978 through Iceland in 2019. Russia is not on that list, and neither is any other post-Soviet state. Even where an agreement exists, SSA can totalize only for a worker with at least six quarters of US coverage. With no agreement, 35 years of Russian stazh add exactly zero US credits. Someone who arrived at 55 and worked nine years here has roughly 36 credits and is short four credits, not four years of Russian work.
Where Your SFR Money Lands: the January 1, 2015 Dividing Line
This is the rule that reframes the whole question, and almost nothing in the search results says it plainly. SFR states on its Vyplata pensii page that pensions awarded after 1 January 2015 to citizens living abroad are paid on the territory of the Russian Federation, in rubles. Only pensions established before 1 January 2015, or under an international treaty, continue to be transferred abroad, in foreign currency at the Central Bank rate on the day of the operation.

For scale, SFR reports paying more than 245,100 people living in 138 countries. The fund also publishes a yearly schedule showing when payment documents for transfers abroad are generated.
Getting the rubles out once they arrive
For a post 2015 award, receiving the pension and receiving the money are two different projects. The funds land in a Russian account by design, and a MIR card does not work in US terminals. Families use one of three approaches: a trusted relative acting under a power of attorney, periodic transfer through a third country account, or letting the balance sit until someone travels. Monthly amounts are modest, so moving money a few times a year is normal. Decree No. 10 of 19 January 2026: When the Transfer Abroad Is Suspended
If the pension was awarded before 2015 and simply stopped arriving during 2026, this is the reason, and it is the part almost no English language page carries. Citing intensified sanctions pressure on the Russian banking system and the holding of transferred funds at correspondent banks, the Russian government adopted Decree No. 10 of 19 January 2026. SFR states on its page on implementing that decree that where transfers abroad in foreign currency cannot be carried out in the previous manner, such payments are suspended by SFR. The decree entered into force on 23 January 2026 and applies to relations arising from 1 January 2026.
This is not a one off. SFR notes that the same approach ran in 2022 under Decree No. 757 of 26 April 2022, and in 2023 to 2025 under Decree No. 493 of 28 March 2023. The practical effect for a US resident is worth stating plainly: the pre 2015 entitlement to be paid abroad survives on paper, while the dollar transfer itself is switched off.
The delivery application, and why it needs no notary
Until the situation is resolved, SFR offers continuation of the payments either inside Russia or outside it in Russian rubles. To arrange this, the pensioner or a representative files a delivery application naming the full details of a bank account in a Russian or a foreign bank. SFR states that this application does not require notarization or consular certification, which makes it the one pension document in this article you can send without a consulate, a notary or an apostille. For payment outside Russia, the application goes directly to the Department of Social Security for Resettlement and Integration, 119991, Moscow, ul. Shabolovka 4, str. 1, GSP-1.
What happens when the restrictions lift
Once that application arrives, or once the restrictive economic measures blocking payment abroad are removed, payments are restored with a supplement for the whole past period, in the order set by law and taking account of Decrees No. 1386 and No. 529. A person who switched to payment under Decree No. 10 may afterwards apply to go back to the previous order, that is, transfer abroad in foreign currency. One warning: none of this pauses the annual proof of life. The money can stop for two unrelated reasons at once, and the 12 month clock keeps running while you sort out the account.
How to Apply From the USA: Forms, Department, Address
Applications go to any territorial office of SFR inside Russia, regardless of where you last lived, or directly to SFR's Department of Social Security for Resettlement and Integration.
A new award
- Two separate forms: the application for award of the pension and the application for delivery of the pension.
- Copy of the internal or foreign passport, and the SNILS certificate if you have one.
- Proof of stazh: original or notarized copy of the trudovaya knizhka, civil law contracts, originals of archival employment certificates.
- An original wage certificate for any five consecutive years, signed by the director and chief accountant and stamped; for 1991 to 2001 it must also show contributions to the Pension Fund.
- Military ID copy, marriage and name change documents, diploma copies, and birth certificates of children together with the document confirming each child survived to age 1.5. The second half of that pair is the one people forget, and the package comes back without it.

Restoring a payment suspended after you moved
Two documents: the application for departure outside the Russian Federation (Annex 1 to Decree No. 1386) and, where the law requires it, the certificate of performance or non performance of paid work abroad (Annex 3). Postal address for people receiving a pension abroad: 119991, Moscow, ul. Shabolovka 4, str. 1, GSP-1. In person reception is at ul. Akademika Anokhina 20, korp. A, client line +7 495 987 80 30.
The Annual Proof of Life and the 12 Month Clock
Under Decree No. 1386 the payment continues only if, once a year, SFR receives confirmation that you are alive. There are four accepted routes.
- Personal appearance at a Russian diplomatic mission or consulate. The officer draws up an act of personal appearance. SFR states this is done free of charge.
- Personal appearance at any territorial office of SFR in Russia, useful if you travel there anyway.
- A document issued by a competent authority or official of a foreign state, which in the USA means a notary public. It needs an apostille and a Russian translation.
- An electronic application through Gosuslugi (EPGU), available to SFR recipients whether the pension goes to a foreign account, a Russian account, or postal delivery in Russia.
The clock, and the mistake of filing early
The confirmation is accepted no earlier than 12 months after the month of the departure application, or of the previous confirmation document or act. It is a rolling personal clock, not a calendar deadline in December. SFR also notes that no confirmation is required in the year the pension is awarded.
SNILS: the line that stops the consulate from issuing the act
Since 27 April 2020, the date RF Government Decree No. 45 of 24 January 2020 took effect, consular pension documents carry a mandatory field for the SNILS number. The New York consulate states that from that date it can draw up the act of personal appearance, the certificate of permanent residence abroad and the certificate on paid work only if the citizen's SNILS is provided. Arriving without the number means arriving for nothing, and if the 12 month window is nearly closed, that trip cannot simply be repeated next week.
Apostille: why a US notary stamp alone is not enough
SFR accepts foreign documents only if they are legalized or bear an apostille, and only with a Russian translation certified by a notary or a Russian consulate. Both countries are parties to the 1961 Hague Apostille Convention: it entered into force for the USA on 15 October 1981 and for the Russian Federation on 31 May 1992. So the correct package is notary certificate, apostille from the Secretary of State of that state, certified Russian translation, mailed to Shabolovka 4.
Which Russian Consulate Covers Your State: New Jersey Against Florida
After the closure of the consulates general in San Francisco and Seattle, the districts were redrawn, and the result surprises people. New Jersey belongs to New York. Florida and California belong to Washington, not to the nearest big city.

The New York consulate routes pension questions, notarization, legalization and issuance of the act of personal appearance to one address, docny@mid.ru. One detail worth knowing before you plan the trip: for the act of personal appearance specifically, that consulate receives visitors Monday to Friday from 9:30 to 12:30 and states that no prior appointment is required. The consular acts themselves are performed free of charge.
Is a Russian Pension Taxable in the USA? Form 1040 Lines 5a and 5b
Yes. The IRS is explicit on the taxation of foreign pension and annuity distributions: "Absent application of a particular treaty provision, foreign social security pensions are generally taxed as if they were foreign pensions or foreign annuities. They are not eligible for exclusion from taxable income the way a U.S. social security pension might be unless a tax treaty provides for an exclusion." That last clause matters, and the next section is about why it no longer rescues anyone in this situation. Foreign pension income is reported with pensions and annuities on Form 1040, lines 5a and 5b, even though no Form 1099-R ever arrives.
Article 17 of the 1992 treaty, and why it no longer helps
The 1992 US Russia Convention placed pensions in Article 17, whose paragraph (b) reads that social security benefits and other public pensions paid by a Contracting State may be taxed only in that State. Paragraph 4 of Article 1 protected that benefit from the saving clause. On 17 June 2024 the Treasury gave formal notice suspending Paragraph 4 of Article 1 and Articles 5 to 21 and 23, and per the IRS treaty page the suspension took effect on 16 August 2024 and continues until the two governments decide otherwise. Article 17 sits inside the suspended range. There is no treaty argument left for a US resident.
No Russian tax withheld means no foreign tax credit
Article 217, paragraph 2 of the Russian Tax Code exempts state pensions, insurance pensions, the fixed payment and funded pensions from NDFL. Nothing is withheld in Russia, so there is nothing to claim on Form 1116. The full amount is taxed once, in the USA. Convert each payment to dollars using the Treasury reporting rates of exchange. The distinction matters in one direction: your right to the SFR pension is outside Form 8938, but the Russian bank account where it accumulates is an ordinary foreign account. Cross $10,000 for a single day and the FBAR is due. This is also why Decree No. 10 has a reporting tail: a pension redirected into a Russian account, or accumulating there while the currency transfer is suspended, can push the aggregate balance over the line for the first time. Failure to file Form 8938 carries a $10,000 penalty, with up to $50,000 more for continued failure after IRS notice.
A Russian Pension and SSI: the Check That Shrinks
Social Security retirement is an earned benefit and is not means tested, so the Russian pension does not touch it. SSI is different. SSA counts pensions as unearned income; after the $20 general income exclusion, countable income reduces the federal SSI payment dollar for dollar. An unreported foreign pension is a classic overpayment case. Eight Reasons the Payment Stops or the Filing Comes Back
- Payments stopped roughly a year after the last contact. Cause: the annual proof of life was never filed. Action: file the act or notarized document; payment is restored for the period under Decree No. 1386.
- A pre 2015 pension stopped arriving during 2026 although the proof of life was filed. Cause: the foreign currency transfer was suspended under Decree No. 10. Action: file the delivery application naming a Russian or foreign account and take the payment in rubles; arrears follow.
- The consulate would not take the document. Cause: wrong consular district. Action: check the district table above; Florida is Washington, not New York.
- The consulate could not draw up the act of personal appearance. Cause: no SNILS number provided. Action: obtain SNILS first; since 27 April 2020 the act cannot be issued without it.
- The US notary certificate was rejected. Cause: no apostille, or no Russian translation certified by a notary or consulate. Action: send all three parts together.
- The bank transfer abroad was never set up. Cause: the pension was awarded after 01.01.2015, so transfer abroad is not available at all. Action: arrange a Russian account and a trusted person instead.
- The application package came back. Cause: copies submitted without originals and without notarization, or a child's birth certificate sent without the document confirming the child survived to 1.5 years. Action: have the Russian consulate certify the copies and complete the pair.
- The confirmation was filed too early. Cause: less than 12 months have passed since the previous act or document. Action: wait for the month the clock actually turns.
Typical Scenarios: Woodbridge NJ 07095 and Coral Springs FL 33065
Typical scenario 1. Raisa, 68, lives in Woodbridge NJ 07095. Her Russian pension was awarded in 2019, so it is paid in rubles inside Russia and cannot be wired to her Chase account at all. Her daughter in Russia operates the account under a power of attorney notarized at the consulate. Once a year Raisa takes the train to 9 East 91st Street in Manhattan, arrives in the 9:30 to 12:30 window without an appointment, brings her SNILS number, and the act of personal appearance is drawn up free of charge.
Typical scenario 2. Valery, 73, lives in Coral Springs FL 33065. His pension was awarded in 2011, so the entitlement to payment abroad survives. In 2026 the money stopped anyway: under Decree No. 10 SFR suspends foreign currency transfers that cannot be carried out in the previous manner. He filed a delivery application naming an account, which required neither a notary nor the consulate, and the pension resumed in rubles with a supplement for the withheld period. Separately he had assumed Florida was served by the New York consulate; it is not, Florida falls under the consular section in Washington DC. Rather than fly, he used a Florida notary for his proof of life, obtained an apostille from the Florida Department of State, added a certified Russian translation and mailed the package to Shabolovka 4. And his Social Security had been reduced under WEP for years; after the Fairness Act, SSA restored the full amount and paid arrears back to January 2024.

At the New York consulate, no. It receives visitors on the act of personal appearance Monday to Friday from 9:30 to 12:30 and states that prior appointment is not required. Can a US notary issue the proof of life instead of the consulate?+

Do I owe Russian tax on the pension, and can I claim a foreign tax credit?+
No and no. Article 217 paragraph 2 of the Russian Tax Code exempts state, insurance and funded pensions from NDFL, so nothing is withheld in Russia. With no foreign tax paid there is nothing to claim on Form 1116, and the full amount is taxed once in the USA.
