Russian Police Clearance Certificate From the USA in 2026: Consulate, MVD, Apostille

The moment is usually identical: an NVC civil documents checklist, a state licensing packet, or an adoption dossier lists a Russian police certificate, and you are in New Jersey or Florida, not in Moscow. Three routes exist from inside the United States, and the fastest of them produces a document that by design can never carry an apostille. This page reflects the rules in force in August 2026 and separates what the U.S. side actually asks for from what applicants assume it asks for.

What each route actually produces

The consular route gives you a certificate issued by the Consulate General or the Embassy consular section. The MVD route gives you the original form described by the State Department reciprocity schedule for the Russian Federation: a document titled СПРАВКА, issuing authority Ministry of the Interior, bearing the stamp of the issuing MVD office and the signature of the official. Only that second object can be apostilled. Gosuslugi is not a third kind of paper but a second way of ordering the MVD document: its paper with apostille option produces the same MVD original, still collected in person in Russia.

Which Russian consular post covers your state

Consular districts were redistributed after the San Francisco and Seattle posts closed. You cannot pick a post by convenience: each one serves a fixed list of states.

The practical consequence of the district map

A resident of Fair Lawn, New Jersey files in New York. A resident of Sunny Isles Beach, Florida files in Washington, not in the nearer Houston post. Brooklyn, Philadelphia and Chicago all sit inside the New York district; Sacramento and Atlanta sit inside the Washington district.

What the consulate asks for, and how New York differs from Washington

New York procedure

  1. Book the service named Справка об отсутствии судимости through the electronic queue at new-york.kdmid.ru.
  2. Bring originals of your valid passports: the Russian internal passport, the Russian foreign passport, or a foreign national passport.
  3. Bring the completed application listing surname, given name, patronymic including any names previously held, date and place of birth, citizenship, and every address of residence or stay in the Russian Federation. The application may also be prepared through the sos.kdmid.ru web service.
  4. For return by mail, bring a prepaid USPS Priority Mail or USPS Priority Mail Express envelope with sufficient postage affixed and a correctly completed return address.
  5. Pay the consular fee on the day of the appointment. New York accepts cash only.

Washington procedure

The Embassy consular section also requires a personal appearance, strictly by prior appointment, and asks for the application form, a copy of every filled page of the identity document, and, when someone else is filing for you, a power of attorney executed either at a Russian consular post abroad or before a notary inside Russia. Guardianship or parentage documents are required when the certificate concerns a minor or a ward. An application may also be pre-filed through sos.kdmid.ru, with follow-up by email to the consular section.

Payment and envelopes: the two details that send people home

  • Payment method is not the same at both posts. New York takes cash only. Washington takes a money order made out to Russian Embassy and states that cash and card payments are not accepted.
  • Washington adds a surcharge of 20 US dollars for consular actions performed on Russian non-working days and holidays.
  • Return envelopes are not interchangeable. New York names USPS Priority Mail and Priority Mail Express. Washington states that FedEx envelopes are not accepted.
  • Consular fee amounts are published per post in the tariff schedule under Article 36 of the Consular Charter of the Russian Federation and change over time. Confirm the current figure with the post before your appointment rather than from a third party page.

The apostille trap: a certificate issued by a consulate cannot be apostilled

This is the single fact that decides which route you take, and it is the one most commercial intermediaries leave out. The Consulate General in New York states plainly that under the Convention Abolishing the Requirement of Legalisation for Foreign Public Documents (The Hague, 5 October 1961), an apostille is not affixed to the certificate it issues. The same page adds that the certificate is valid in every state party to the Convention without further certification.

Why that is not an oversight but the design of the treaty

Article 1 of the 1961 Convention states that the Convention does not apply to documents executed by diplomatic or consular agents. A certificate handed to you by a Russian consular post is exactly such a document, so no authority anywhere can lawfully attach an apostille to it. The consulate's position and a receiving body's checklist can therefore both be internally consistent and still collide: if your reader insists on seeing the apostille stamp itself, no amount of follow-up correspondence with the consulate will produce one, and the MVD original is the only object that can carry it. The MVD route through a power of attorney: GIATS, 30 calendar days, 2,500 rubles

The power of attorney

The State Department reciprocity schedule confirms that people residing outside Russia may either delegate a power of attorney to apply on their behalf inside Russia, or apply directly to the Russian consulate where they reside. For the first path the power of attorney must be notarized. If you are in the United States, you can have it executed at the Russian consular post covering your state, which is the same appointment system used for renewing a Russian foreign passport in the USA.

Timeline and the apostille add-on

  • MVD Order No. 660 of 27 September 2019, paragraph 10: the service term must not exceed 30 calendar days from registration of the application. Paragraph 11 allows the head of GIATS MVD or of the regional IC, or the official acting in that capacity, to extend the review where additional information is needed by no more than another 30 calendar days, with notice to the applicant.
  • Apostille: only MVD may affix it. Your proxy applies at the IC that issued the certificate or at GIATS MVD in Moscow, carrying a passport, the certificate, and a notarized power of attorney with notarized copies of your passport pages. The apostilled paper certificate can also be ordered through Gosuslugi service 600103 by selecting the certificate type paper with apostille, instead of an in-person visit. State duty is 2,500 RUB per document, and the portal states the apostille may take up to five additional days on top of the certificate itself.
  • A paper certificate that is not collected within three months of the application registration date must be ordered again. There is no duplicate of a lost certificate: you order a new one and pay the 2,500 RUB apostille duty again.

Who needs a Russian police certificate: the 6 month and 12 month rules

The table below reproduces the Department of State civil documents instructions for Step 7 of an immigrant visa case, including the age condition. The underlying residence thresholds sit in 22 CFR 42.65(c)(1), which defines the appropriate police authorities as those of a country where the applicant resided at least six months, for the country of nationality and the country of current residence, or at least one year for any other country. Together these rules are why many people order a certificate they do not need, and a few skip one they do.

The exemption almost everyone misses

Present and former residents of the United States do not submit U.S. police certificates. A consular officer may still require a certificate regardless of length of residence if there is reason to believe a police record exists in that locality, per 22 CFR 42.65(c)(1).

Does USCIS require a Russian police certificate for Form I-485?

No, not as a blanket item. The USCIS checklist of required initial evidence for Form I-485, for both family-based and employment-based applicants, lists certified police and court records of all criminal charges, arrests, or convictions regardless of final disposition, if applicable. The condition is real: with no charges, arrests or convictions, there is nothing on that line for you to file.

Where the police certificate requirement actually lives

It lives in the consular immigrant visa track. Under 22 CFR 42.65(b), an immigrant visa applicant must furnish, if obtainable, a copy of a police certificate or certificates. Note the word copy: the regulation does not ask for an original, and it says nothing about an apostille. The Russia page of the reciprocity schedule repeats the instruction to send a copy of the police certificate to the National Visa Center.

Certified translation under 8 CFR 103.2(b)(3): what counts

Your certificate will be in Russian. For USCIS, 8 CFR 103.2(b)(3) requires that any document containing a foreign language be accompanied by a full English translation which the translator has certified as complete and accurate, plus the translator's certification that they are competent to translate from that language into English.

What a valid certification is and is not

  • It is a signed statement from the translator covering two points: the translation is complete and accurate, and the translator is competent to translate.
  • It is not a notarization, and it is not an apostille. Neither is required by 8 CFR 103.2(b)(3).
  • The immigrant visa instructions use the same two-point formula for documents sent to the National Visa Center.
  • An apostille never removes the translation duty: an apostilled Russian certificate still needs its certified English translation.

How long a Russian police certificate stays valid

For immigrant visa purposes the Department of State states that police certificates expire after two years, with one exception: a certificate issued by a country of previous residence remains usable if you have not returned to that country since it was issued. Inside Russia, the portal notes that neither the certificate nor the apostille carries a statutory expiry, which is why a Russian-side lawyer and a U.S.-side officer can give you two different answers to the same question. The controlling number for your U.S. filing is two years.

Timing the order against the interview

Order the certificate so that it is under two years old at the interview, not at the moment you upload documents. Ordering it too early is the more common mistake: a certificate obtained at the start of a case that then waits a year for a priority date can expire before the interview.

Electronic certificate from Gosuslugi versus paper: why printing the PDF fails

The Russian portal offers the certificate in electronic and paper form and states the two are legally equivalent. The electronic version arrives as a PDF accompanied by an MVD employee signature in a separate .sig file. The portal states explicitly that a printed electronic certificate has no legal force.

What that means for a U.S. filing

Printing the PDF and mailing it with your packet produces a page that the issuing state itself does not treat as a document. If you need something to hand to a U.S. agency or a licensing board on paper, order the paper certificate and collect it within three months of the application registration date, otherwise you have to order a new one.

Where Russian immigrant visa cases are interviewed: Warsaw, Tashkent, Almaty

The certificate is one item in a case that will not be interviewed in Moscow. Immigrant visa services at U.S. Embassy Moscow are suspended, and the Department of State designated U.S. Embassy Warsaw as the immigrant visa processing post for nationals and residents of Russia. On 16 February 2023 the Department added U.S. Embassy Tashkent and U.S. Consulate General Almaty as processing posts for Russian IR-5 applicants, the parent of a U.S. citizen category; Warsaw remains the post for all other categories. Moscow also cannot accept local filing of Form I-130.

Six ways this goes wrong and what to do

  • Symptom: the licensing board rejects the consular certificate. Cause: its checklist requires the apostille stamp, which a consular document cannot receive under Article 1 of the 1961 Hague Convention. Action: switch to the MVD original, ordered either by notarized power of attorney or through Gosuslugi service 600103, and budget 30 calendar days plus the 2,500 RUB duty.
  • Symptom: you are turned away at the appointment without service. Cause: wrong payment instrument. Action: cash for New York, money order payable to Russian Embassy for Washington, and add 20 US dollars if the day is a Russian holiday.
  • Symptom: the certificate is never mailed back. Cause: the wrong carrier envelope. Action: use prepaid USPS Priority Mail or Priority Mail Express for New York; Washington does not accept FedEx envelopes.
  • Symptom: the certificate omits a city where you lived. Cause: the application did not list every address of residence or stay in Russia. Action: list all of them, including former surnames, so the certificate names the MVD branches queried.
  • Symptom: the agency returns your Russian document unread. Cause: no certified English translation. Action: attach a translator statement covering completeness, accuracy and competence per 8 CFR 103.2(b)(3).
  • Symptom: your certificate is refused at the interview as stale. Cause: the two year expiry. Action: reorder and time the new certificate to the interview date, not the document upload date.

A green card holder applying for a state professional license is told the packet must include an apostilled Russian criminal record certificate. The consular route in New York would have produced a document in about a working week, but no apostille can be affixed to it. The consulate states its certificate is valid in all Convention states without further certification, so it is worth asking the board whether that satisfies the line. If the board insists on the apostille stamp itself, only the MVD original can carry one: a power of attorney executed at the New York post, a relative applying at the regional IC or an order placed through Gosuslugi service 600103, and the apostille from MVD at 2,500 RUB, planned around 30 calendar days plus up to five days for the apostille itself.
